Assumption of Risk Agreement and Liability Waiver

Read this Agreement carefully. A parent/guardian must sign for minors (under 18 years of age).
Assumption of Risk: I have voluntarily applied to participate in a tour conducted by “SeaTrek Limited” which will involve “Adventure Activities” and/or small ship cruising and other outdoor water related and land based events. I am voluntarily participating in this tour with the knowledge of the risks and possible dangers involved. It is my intention to fully assume all risks associated with this tour and to release SeaTrek from any and all liability.
Release of Liability: In consideration of and the payment for, the right to participate in the cruise and for the services arranged for me by SeaTrek, I agree to be responsible for my own safety and wellbeing and assume all risks
inherent to this cruise. Except in instances of gross negligence by Sea Trek staff or crew, I agree to release SeaTrek, their owners, employees, shareholders, affiliated entities, from and against any liability, which may hereafter arise
out of or in connection with my participation in the activities arranged for me by SeaTrek.
Applicable Law and Choice of Forum: Any negotiated and yet unresolved dispute arising out of this agreement shall be litigated and determined before a court in the jurisdiction in Bali, Indonesia.
Statement of Acceptance
I have read and understand the provisions above and I am signing freely.
I agree that execution of a facsimile counterpart or electronic transmission of this agreement shall be considered execution of the original agreement. I agree that facsimile or electronic transmission of an executed copy of this agreement shall constitute acceptance of this agreement.
MINOR PARTICIPATION LIABILITY RELEASE
I/we are the parent or legal guardian of the minor named below. I understand in that in signing that I/we are releasing SeaTrek from all liability on my and the minor’s behalf while participating in the “Adventure Activities” of the tour. Further, I/we assume all risks of the minor’s participation in the tour, and indemnify SeaTrek and understand that I am responsible for acts of the identified minor.
